Judge Rules “Sex Is Changeable” – Hands Women’s Safe Space To A Man

A Federal Court judge in Australia has just declared “sex is changeable” and ordered Sall Grover to pay $10,000 in damages for removing a biological male from her women-only app, Giggle for Girls.

Roxanne Tickle – a man who underwent surgery and obtained a new birth certificate – sued after the app’s AI and visual verification systems blocked access for not appearing female.

Justice Robert Bromwich ruled this amounted to indirect discrimination under the Sex Discrimination Act, determining that “sex” now includes transgender identities, effectively requiring Grover’s women-only platform to allow access.

This isn’t framed here as inclusion. It is presented as the erosion of female-only spaces under legal reinterpretation.

Grover created Giggle as a female-only refuge, specifically for women affected by male violence and abuse. The ruling removes the ability to enforce that boundary, meaning the platform can no longer operate as originally intended.

The implications raised include:

  • Loss of single-sex safe spaces for women
  • Legal redefinition of sex-based protections
  • Potential impact on women recovering from trauma
  • Expansion of access based on gender identity rather than biological sex

The argument put forward is that this decision does not affect just one app, but sets a precedent impacting all female-only environments, particularly those created for safety and recovery.

Supporters of the ruling argue it enforces anti-discrimination protections.
Critics argue it removes the legal foundation for sex-based boundaries.

At the centre of the issue is a broader question:

Are women’s spaces defined by biological sex, or by gender identity under law?

This decision signals a clear legal shift toward the latter.

The consequences of that shift remain deeply contested.
